I need help. I want to move teaching jobs, but have to give 3 months notice, which I cannot do, otherwise I will lose my new position. My current company, also say I have to pay 3 months visa costs if I leave within a year. I've been with the company less than 3 months. What rights do I have if any?
My employment contract, says I have to give 3 months notice and pay 3 months salary if I leave within a year. I've only been with the company just under 3 months. Apart from admin costs, I know that a visa doens't cost the equivalent of 3 months salary. I'm over my probation period of 1 month, so looks like I'm stuck.
The job description, doesn't match what I'm doing, so I'm hoping that's my way out. Breach of contract as it were. The company doesnt' owe me any money, more like they want nearly half a years salary from me, just because I want to leave...it's ridiculous.!!
If they don't owe you any or much money, the risk you could take would be to just walk out. The only way they could get three months salary from you would be to take you to court which is probably unlikely - lie and say you are leaving Hong Kong.
